Housing Disrepair Claims Now Open to Private Renters

Housing Disrepair Claims Now Open to Private Renters

For the first time in our 24-year history, Pabla & Pabla Solicitors are now extensively looking to represent privately renting tenants in Housing Disrepair claims against their landlords. This marks an important and exciting change to our business, and we are now actively seeking to help private renters who are living in disrepair.

For too long, privately renting tenants have struggled to obtain legal assistance in a claim against their landlord. If you are paying to live in a privately rented home, then we think your ability to hold your landlord to account should be no different to any other tenant. Pabla & Pabla are here to help private tenants obtain the same outcome.

Why can private renters now make Housing Disrepair claims?

Since the inception of our Housing Disrepair department, we have assisted thousands of social housing tenants who have suffered with disrepair – but poor living conditions are not exclusive to social housing tenants alone. We have always wanted to represent private tenants as well, but historically there were several reasons which made it much harder for law firms like ours to do so.

One large reason for this was the relative insecurity of private tenancies. For years, when a private tenant brought a claim against their landlord, many simply evicted their tenants using the highly controversial Section 21 No Fault Eviction process. If the tenant no longer lived in the property, the claim would often collapse and the landlord was able to escape censure and simply find a new tenant to replace them. This meant that many private renters simply chose not to make a formal claim for fear of this process happening. Given the desperation for housing, landlords had no real difficulties in replacing the complaining tenant.

The byproduct of this was that there was no real market for private tenant redress and very few firms were able to provide a service which protected their client from adverse costs. However, due to a change in the law, this is a situation we hope to reverse.

We have written separate articles on the The Renters’ Rights Act which came into force on May 1st, 2026 and one change this Act brought, was a significant strengthening of the legal rights of private tenants and the abolition of a Section 21 eviction.

The result of this change, and due to our reputation and experience within the industry, Housing disrepair claims for private renters are now much more accessible though Pabla & Pabla.

How does a private tenant Housing Disrepair claim work?

In short, the exact same way as a Housing Disrepair claim for a social housing tenant!

The process starts with the tenant submitting information about their ongoing disrepair issues to a law firm, who assess the evidence provided. If they assist private tenants like Pabla & Pabla do, then they will consider the information to see if they can take on the claim.

Every law firm works a little differently, but most need to check the same things to see if they can take on the case, these being :

  1. Evidence of the landlord being notified of the disrepair. This could be a screenshot of phone messages or saved emails. To succeed with a disrepair claim, the landlord needs to know about the disrepair and had longer than a “reasonable” amount of time without completing the repair.
  2. A copy of the tenancy agreement. This could be a digital or physical copy and is checked to ensure the landlord owns the property where the tenant resides, and is legally responsible for the repairs.
  3. Evidence of the disrepair. This could be photographs or videos, showing the full extent of the disrepair.

If the law firm agrees to take on your claim, you will likely be offered to sign a No Win, No Fee agreement with them. Essentially, this means that you don’t pay any money upfront to start the claim, and you don’t have to pay any legal fees if the case isn’t successful.

Once the agreement between the law firm and the client is dealt with, the process starts with a letter of claim being sent to their landlord. Court rules state that a response should be provided within 20 working days and hopefully, negotiations over the repairs will flow from there.

In most cases, an expert surveyor will visit the property and produce a high-quality report on the disrepair. This ensures the work done by the landlord is sufficient to provide the tenant with the safe and habitable home.  The report usually contains the vital information needed to settle a claim. This is then used to agree a legally binding agreement for that work to be done, together with payment of compensation.

In rare instances where the landlord completely refuses to accept responsibility, then the tenant should be given detail on their options. If they are to issue court proceedings to force the landlord to make repairs, it is important for tenants to know that they are protected from any negative costs.

The above details what a good, competent law firm should offer to tenants seeking redress. Pabla & Pabla are currently one of the very few who can also offer this service to private tenants and we look forward to providing this help in the future.

Lastly, it is important to remember that a landlord cannot legally evict their tenant just for making a Housing Disrepair claim. So, if your landlord refuses to enact the repairs following your requests, then bringing a legal claim is a safe and viable way to get that work done (and be compensated for the trouble).
