Pabla + Pabla Solicitors Secures £36,100 for Claimant in Fundamental Dishonesty Case

We are proud to announce that Christian Potter, Partner at Pabla + Pabla Solicitors, recently secured a significant victory for a claimant in a case where the defendant pleaded Fundamental Dishonesty. Working with barrister David Boyle, our legal team successfully achieved a total award of £36,100 plus interest, defeating the dishonesty allegations and securing various compensation awards for our client.

The case involved a claimant, a passionate cyclist, who suffered severe injuries after being knocked off his bike. He sustained fractures to both wrists, with the right wrist requiring plating. Despite a determined effort to return to cycling and resume his normal activities, he struggled physically and psychologically, eventually leading to him giving up road riding entirely.

The defendant argued that the claim was fundamentally dishonest due to discrepancies in medical reports. However, after thorough cross-examination of both the claimant and his wife, the court held that the inaccuracies were minor and did not constitute dishonesty. The claimant was awarded the full sum for his pain and suffering, as well as damages for bike repairs, Smith v Manchester compensation, and a ground-breaking award for Loss of Leisure Time.

This victory highlights the exceptional legal expertise at Pabla + Pabla Solicitors and our commitment to achieving justice for our clients. We are pleased that the court rejected the defendant’s attempts to impugn the claimant’s character and that justice prevailed.
