Probate & matters following death

Probate & matters following death

Dealing with the loss of a loved one can be a very difficult time for family members, who often don’t want the burden of dealing with the deceased’s estate. At Pabla & Pabla solicitors we are specialist advisors in probate matters.

Estate matters can seem straight forward if there are no inheritance tax implications of the estate. However, the people placed in the role as Executor or Administrator of an estate often do not understand the duties that they are placed under in taking on that responsibility. We have procedures in place to ensure you meet all the duties that you are under to ensure no criticism or liability can be held against you personally. You are under a duty to not only administer the estate according to a Will, but also to adequately protect the assets of the estate.

With more complex estates, detailed tax forms may need to be completed to ensure that any inheritance tax is paid at the appropriate times. There may also be situations whereby we would advise on tax planning to reduce the liability of the estate. We would strongly recommend that if you are appointed as an Executor or as an Administrator of a will, you should seek legal advice to adequately protect yourself from any liability going forward.
